ENDING TENANCY
The amount of notice a tenant must give is dependent on the type of tenancy agreement they have. If a tenant cannot give the right amount of notice a landlord might be able to agree with them to end their tenancy agreement early. This is called ‘surrendering your tenancy‘.
A tenant may have a ‘fixed term tenancy‘ which ends on a certain date or a ‘periodic tenancy’, which just continues a monthly or weekly basis. A periodic tenancy is also known as a ‘rolling tenancy’.
Some break clauses might have other conditions that a tenant must comply with. For example, your break clause might say you can’t have rent arrears.
Tenants can Contact their nearest Citizens Advice if they don’t understand their break clause.
